Private parking charge vs council PCN — how to tell the difference

People often call every ticket a “PCN”. In the UK that abbreviation usually means a council Penalty Charge Notice. A letter from a private parking company is a different animal — different law, different deadlines, different next step after rejection.
Quick comparison
| Check | Private parking charge | Council PCN |
|---|---|---|
| Who issued it? | A parking company (operator) | A local authority / council |
| Typical logos | BPA or IPC | Council crest / local authority name |
| First challenge | Appeal to the operator | Informal challenge / representations to the council (process varies by stage) |
| Independent next step | POPLA (BPA) or IAS (IPC) | Traffic Penalty Tribunal or London Tribunals (and related London processes) |
| Main “rules of the road” | Contract / Code of Practice / POFA (keeper) | Traffic Management Act 2004 and related regs |

How to read the paper in your hand
Look at the header and legal wording, not just the word “PCN”:
- Council: names the council; talks about Penalty Charge Notice; often explains discounted payment and statutory appeal rights to a tribunal.
- Private: names a limited company or trading name; talks about a parking charge / parking charge notice; may invite you to appeal to the company and later POPLA or IAS.
If you are still unsure, the GOV.UK page above walks through both paths side by side.
Why the difference matters
Using a POPLA letter against a council ticket (or a tribunal pack against a private operator) will not help. Deadlines can pass while you chase the wrong body.
Private appeals lean on:
- the Private Parking Code of Practice;
- POFA 2012 Schedule 4 where keeper liability is claimed;
- POPLA or IAS.
Council challenges lean on statutory grounds and tribunal guidance (for example Traffic Penalty Tribunal grounds outside London, and London Tribunals in London).
