After a Notice of Rejection — how to appeal a council PCN to the tribunal

Not legal advice. This article is general information and a pointer to letter templates only. Claim Helper does not act as your solicitor, representative, or claims management company, and does not represent you at tribunal. Outcomes are not guaranteed. Confirm you have a council Penalty Charge Notice, not a private parking charge. Official starting point: GOV.UK — Challenging a ticket.

If the council sends a Notice of Rejection (NoR) of your formal representations, you generally have 28 days to either pay or appeal to an independent adjudicator. Missing that window can lead to a Charge Certificate and higher enforcement.

Which tribunal?

Where the PCN was issuedAppeal body
LondonLondon Tribunals — Environment and Traffic Adjudicators
England outside London / WalesTraffic Penalty Tribunal (TPT)

Process overview: GOV.UK — Challenging a ticket. London process detail: London Tribunals — parking PCN enforcement. TPT “what to do next”: TPT guidance.

Scotland and Northern Ireland use different systems — do not use the England/Wales path blindly.

What to do in the 28 days

  1. Read the NoR carefully — it should explain how to appeal and the deadline.
  2. Decide pay vs appeal — paying usually ends the dispute. Appealing means you continue to contest the PCN.
  3. Appeal online via the correct tribunal (links above). Use the appeal pack / codes on the NoR.
  4. Ground your appeal in a statutory ground where possible (for example contravention did not occur; not the owner; procedural impropriety). See TPT parking grounds and London Tribunals grounds hub.
  5. Upload evidence — photos of signs/markings, tickets/app receipts, Blue Badge, delivery notes, timeline.
  6. Mitigation / compelling reasons — councils may cancel as discretion earlier; at tribunal, adjudicators generally cannot allow solely on mitigation but may refer back in some cases. Check each tribunal’s guidance.

Claim Helper’s council PCN letter generator is for informal challenge and formal representations to the council — not an automated tribunal Notice of Appeal. For the tribunal stage, use the official online appeal forms.

Charge Certificate risk

If you neither pay nor appeal in time after the NoR, the authority may issue a Charge Certificate and the amount can increase. GOV.UK summarises escalation on the challenging-a-ticket page. Do not ignore post from the council or enforcement agents without checking what stage you are at.

DIY path vs private parking

Council PCNs go to TPT / London Tribunals. Private company parking charges go to POPLA or IAS after the operator stage — different rules (GOV.UK; private vs council guide).
